1. Seller
These Terms and Conditions govern access to and use of the aurealuxurylab.com website and the purchase of the products offered on it.
The site is operated and the products are sold by Aurea Luxury Lab S.r.l., with registered office at Via Armando Pica 170 E, 41121 Modena (MO), Italy. C.F. and P.IVA 04262050364, REA MO-456214. PEC aurealuxurylab@postecertifica.it — E-mail info@aurealuxurylab.com.
In this text, the terms "we", "us", "our" and "the Company" refer to Aurea Luxury Lab S.r.l. The site is built on the Shopify platform.
2. Acceptance of the Terms
By accessing the site or placing an order, you accept these Terms and the Privacy Policy. If you do not wish to accept them, please do not use the site.
Please read these Terms carefully, as they contain important information about your rights, the purchasing process and the applicable limitations of liability.
These Terms do not affect the mandatory rights granted to consumers under applicable law.
3. Access to the site and account
The site is intended for users of legal age. Minors may use it only under the supervision and with the consent of the person exercising parental responsibility.
To make a purchase, you may be asked to provide your e-mail address and billing, payment and shipping details. You warrant that the information provided is true, complete and up to date and that you are entitled to provide it.
You are responsible for safeguarding your account credentials and for the activities carried out through your account. The account may not be assigned or transferred to, or operated by, third parties.
4. Nature of the products
Aurea Luxury Lab sells exclusively pre-owned luxury bags and accessories, that is, pre-owned (used) goods.
As these are pre-owned (used) goods, the items may show signs of use, imperfections, colour variations, oxidation of hardware, creases or patina resulting from normal previous use. These characteristics are indicated in the product description and documented in the photographs, which faithfully represent the item actually for sale and are not retouched to improve its appearance.
The brand's original packaging, such as the box or dust bag, may not be available. In that case, the product is supplied with Aurea Luxury Lab packaging and dust bag.
5. Authenticity and certifications
Every item undergoes a quality inspection at our laboratory and, where the brand and model are supported by the system, a check using digital authentication technology.
The digital authentication certificate, where available, is issued and included in the sale price as an ancillary service. Where the model is not supported by the system, the purchase receipt together with the internal inspection constitutes proof of authenticity.
The unavailability of the digital certificate does not constitute a lack of conformity or grounds for withdrawal or refund, as it is an ancillary service provided at no additional cost.
6. Representation of the products
The images published show the item actually for sale. Colour rendering may vary depending on the device, screen settings and lighting conditions, without this constituting a non-conformity of the product.
Descriptions and availability may be changed at any time. We reserve the right to withdraw an item from sale and to limit the quantities that may be purchased.
7. Prices
All prices are expressed in Euro and include applicable tax. Shipping costs, where due, are shown separately before the order is placed.
For shipments outside the European Union, customs duties, import taxes and customs clearance charges are borne by the recipient and are not included in the price.
Prices, discounts and promotions may be changed at any time. The price applied is the one in force at the time the order is submitted, as shown in the confirmation e-mail. Promotions may be subject to specific conditions, which prevail over these Terms in the event of conflict.
8. Conclusion of the contract
Submitting an order constitutes an offer to purchase. The contract is deemed concluded when we send confirmation that the order has been accepted.
We reserve the right not to accept an order, giving notice thereof, in cases of subsequent unavailability of the item, a manifest error in the price or description, a negative outcome of anti-fraud checks, incomplete or unverifiable shipping details, or previous unpaid amounts or pending disputes.
If an order is not accepted or is cancelled, any amount already paid is refunded in full.
As these are unique items, the order cannot be modified after acceptance. Cancellation requests are assessed according to the processing status of the order, without prejudice to the rules on the right of withdrawal.
Purchases are intended for personal use. Purchasing for commercial resale is not permitted without our written consent.
9. Payments
The payment methods shown at checkout are accepted, including credit and debit cards, digital wallets, PayPal and deferred payment solutions offered by third-party providers.
Deferred payments are provided by third parties under contracts concluded directly between you and the relevant provider, to which the conditions set by that provider apply. We play no part in the assessment or management of such relationships.
Full payment instrument data is processed directly by payment service providers and is not stored on our systems.
Payment must be completed in full before shipment. If payment is unsuccessful, the order is cancelled.
10. Shipping, delivery and transfer of risk
The delivery times indicated are estimates and run from the fulfilment of the order. We are not liable for delays attributable to carriers, customs procedures or events beyond our control.
The risk of loss of or damage to the goods passes to the consumer customer when the customer, or a third party designated by the customer other than the carrier, takes physical possession of the goods.
Where the customer gives the carrier directly instructions that differ from the delivery methods provided for at the time of the order, such as leaving the parcel without a signature, delivery to third parties or leaving it in unattended places, the risk shall be deemed to have passed at the time such instructions are carried out.
Given the nature and value of the items, we recommend receiving the parcel in person or choosing delivery to an official pick-up point.
11. Right of withdrawal
The consumer customer may withdraw from the contract within 14 calendar days of delivery, without giving any reason, in accordance with the methods, time limits and conditions set out in the Returns and Refunds Policy, which forms an integral part of these Terms.
12. Legal guarantee of conformity
The legal guarantee of conformity provided for by current legislation applies to the consumer customer.
As these are pre-owned (used) goods, the parties expressly agree that the legal guarantee of conformity lasts 12 months from delivery of the goods.
Signs of use and the characteristics referred to in article 4 do not constitute a lack of conformity when they are described in the product page, documented in the photographs or otherwise consistent with the stated condition.
13. Aurea ReBag service
The Aurea ReBag service allows private individuals to offer pre-owned (used) luxury items to the Company for sale or trade-in. The service is governed by specific conditions, available in the relevant section of the site, which prevail over these Terms with regard to item submission arrangements.
14. Intellectual property
The content of the site, including texts, images, graphic elements, videos, layout, and the selection and arrangement of content, is owned by the Company or its respective licensors and is protected by current legislation on intellectual and industrial property.
The trademarks, logos, names and distinctive signs on the site that refer to Aurea Luxury Lab may not be employed without prior written consent.
The trademarks of the manufacturers of the goods sold belong to their respective owners. Aurea Luxury Lab is an independent reseller of pre-owned luxury items and is not affiliated with, associated with, authorised by or in any way connected to the owners of such trademarks.
Reproduction, distribution, modification, publication or transmission of the content of the site without written consent is prohibited, except for personal and non-commercial use.
15. Reviews and user content
Content you send us, such as reviews, comments, suggestions, images or videos, may be utilised, reproduced and published by us for purposes connected with the management and promotion of the Services, free of charge and without territorial or time limits.
You warrant that you hold the necessary rights to the content submitted and that it does not infringe the rights of third parties or contain unlawful, defamatory, offensive or misleading material. You are responsible for the content you submit.
We reserve the right, without being obliged to do so, not to publish or to remove content deemed unlawful or inappropriate.
16. Prohibited uses
The site may be accessed for lawful purposes only. In particular, it is prohibited to: violate legal provisions or the rights of third parties; infringe intellectual property rights; transmit false or misleading information; harass or harm employees, collaborators or other users; impersonate third parties; transmit malicious code; reproduce, extract, resell or exploit parts of the site; collect personal data of other users; send unsolicited communications; circumvent security or access restriction measures.
We reserve the right to suspend or deactivate the account in the event of a breach of these Terms.
17. Automated systems and agents
Access to the site by means of robots, spiders, scraping tools, data collection and extraction systems or other automated processes is permitted only with prior written authorisation.
Automated systems and software agents accessing the site must identify themselves as such in their requests, may not simulate human behaviour, may not circumvent measures designed to distinguish human from automated access and must comply with the technical restrictions we have adopted.
18. Third-party tools, content and links
The site may integrate tools or content provided by third parties and contain links to external sites over which we have no control. Use of such tools and access to such sites are at the user's own risk and are subject to the conditions set by the respective providers.
Complaints and requests relating to third-party products or services must be addressed directly to the party concerned.
19. Relationship with Shopify
The site is built on the Shopify platform. All sales and purchases are concluded directly with Aurea Luxury Lab S.r.l. Shopify is not a party to the sales contract and is not liable for the products purchased or for the relationship between the Company and the customer.
20. Liability
We are liable for failure to perform the obligations undertaken towards the customer in accordance with applicable law.
To the extent permitted by law, we are not liable for indirect damages, loss of business opportunities, loss of data or harm resulting from interruptions, unavailability or malfunctions of the site not attributable to our fault.
No provision of these Terms limits or excludes liability for wilful misconduct or gross negligence, or the mandatory rights of the consumer, including the legal guarantee of conformity.
21. Errors and inaccuracies
The information published may contain clerical errors or inaccuracies relating to descriptions, prices, availability, costs or delivery times. We reserve the right to correct such information and, in the event of a manifest error in the price or description, not to accept the order, giving notice thereof and refunding in full any amount paid.
22. Changes to the Terms
We may update these Terms by publishing the current version on this page. Orders are governed by the Terms in force at the time the order is submitted.
Material changes are communicated as required by applicable law.
23. Governing law and competent court
These Terms are governed by Italian law.
For disputes with consumer customers, the court of the consumer's place of residence or domicile has exclusive jurisdiction, if located within the territory of the State. Any more favourable mandatory provisions under the law of the consumer's country of residence remain unaffected.
For disputes with customers who are not consumers, the Court of Modena has exclusive jurisdiction.
24. Dispute resolution
Consumers may use the European online dispute resolution platform, accessible at https://ec.europa.eu/consumers/odr
In any case, we invite you to contact us first, so that we can look into your request and seek a solution.
25. Final provisions
The invalidity or ineffectiveness of any clause does not affect the validity of the remaining provisions.
Failure to enforce any provision of these Terms does not constitute a waiver of it.
You may not assign to third parties the rights and obligations arising from the contract without our written consent. The Company may assign the contract in the context of corporate transactions, without prejudice to the rights of the customer.
